Man Charged With Driving Under The Influence Of Caffeine Says It's Ruined His Life

The chances are that your morning routine probably includes an enormous amount of caffeine to give you the much-needed energy to actually get out of bed and drive to work every morning. 

But that could be about to change. KCRA reports 36-year-old Joseph Schwab, from Fairfield, California, is in court his holiday season facing a driving under the influence charge after he was pulled over while driving home from work in August 2015. 

The agent said Schwab was driving erratically and she believed he was under the influence of drugs. The agent says that a field sobriety test revealed Schwab had dilated pupils. 

Schwab agreed to a blood test, saying he hadn't taken any drugs, and caffeine was the only substance that was detected. 

That's when prosecutors decided to charge Schwab with a DUI for having one too many coffees. Saying that they believe Schwab was "under the influence of a drug they don’t screen for."

Experts told KCRA that while caffeine is a drug, it’s not known to cause impaired driving, and might even help with driving in some cases.

Schwab’s attorneys say they are "stunned" at the charge, and are asking for them to be dismissed, saying that driving under the influence of caffeine is not a crime.

“This is a case without a blood result, right, so it makes it a very difficult challenge to prove in court to not have the blood result,” said Solano County District Attorney Krishna Abrams.


Schwab says that after a year of fighting the charge, the ordeal has hurt him financially and damaged his reputation.

“Looks like I’m undependable. And when you tell this type of story to somebody, they are naturally not going to believe you.”
